Terms of Service

These Terms of Service ("Terms") govern your use of Fantasy Apples ("the App"), a web app at https://fantasyapples.com, operated by Studio Infinite Lives, LLC ("we", "us", "our"). By using the App you agree to these Terms. If you do not agree, please do not use the App. Our Privacy Policy, which explains what we collect and why, sits beside these Terms.

1. Who we are

Studio Infinite Lives, LLC operates Fantasy Apples. You can reach us about anything in these Terms at support@infinitelives.io.

Fantasy Apples is a fantasy hockey companion built to work with any fantasy hockey platform. We test it internally with Yahoo Fantasy Hockey head-to-head categories leagues. It is not made, endorsed or supported by Yahoo or any other fantasy platform.

2. The free public beta

Fantasy Apples is a free public beta, so expect rough edges, changes and the occasional reset. Features may change or be removed, and the App may be unavailable at times. We may need to reset or migrate the data you enter during the beta; we will try to warn you first, but please keep your own copy of anything you can't easily re-enter (such as your projection files). Using the App costs nothing during the beta. Being an OG (section 5) is free and never required to use it.

If the App ever charges. After the beta we may charge for the App, or for some of its features, for example through a subscription. If we do, we will tell you in the App before anything you use stops being free, and you can keep using whatever stays free. Being an OG does not include free or discounted access to any paid plan or feature; section 5 sets out exactly what it is.

3. Your account

You sign in with your Yahoo or Google account. That provider's own terms apply to that account.
An account is for one person. Don't share it or use someone else's.
Keep your Yahoo or Google sign-in secure. You are responsible for what happens under your account.
You must be old enough to use the App, as our Privacy Policy describes.

4. Acceptable use

You agree not to:

scrape, crawl or bulk-download the App or its data, or use automated means to access it, other than a normal browser;
interfere with, overload, probe or try to break the App, its security, or other users' accounts;
use the App to break the law, or to upload or post anything unlawful, infringing, harassing or harmful;
resell, rent or re-publish the App or its data, or pass it off as your own.

We may suspend or close an account that breaks these rules.

5. The OG

The OG is free, always: nothing in the App is sold. You earn it by helping shape Fantasy Apples on the feature board, where anyone signed in can post feature requests, read approved ones and vote for them.

OG. When we approve a feature request you posted, your account becomes an OG and shows the OG badge.
OG+. When we build a feature request you posted (we mark it Done), your account becomes an OG+.

How The OG works:

Voluntary. Nothing in the App requires it.
Approval is ours. We decide which requests to approve, decline or build. A request waits for our approval before anyone else can see it, and we may remove any request (section 7).
No promise to build. Feature requests are suggestions. We read them, but we don't promise to build any of them, or on any timeline.
It stays yours. Once earned, the OG or OG+ status stays on your account, even if the request is later removed, for as long as we operate the App. We may remove it from an account that breaks these Terms (sections 4 and 7).
Nothing else changes. The OG is a badge. It doesn't change the App's features and gives no other access, payment or reward.

Tips. You can also leave a tip through Support (under Account, on the OG sheet and on the welcome message), which opens PayPal. A tip is a voluntary gift to Studio Infinite Lives, LLC, in any amount (the suggested amounts are only suggestions). It does not make you an OG and gives you nothing in return: no badge, features or other access. A tip is not a charitable donation and is not tax-deductible. PayPal's own terms apply to the payment; to ask for a tip back, write to support@infinitelives.io.

6. Refunds and disputes

Nothing in the App is sold, so there is nothing to refund. To ask for a tip back, write to support@infinitelives.io.

7. Conduct on the boards

The feature board and any other boards in the App are shared with everyone signed in. Posts must be on topic and lawful, and must not include personal data about anyone else. We may edit or remove any post, and remove a user's access to the boards for abuse. You keep ownership of what you post, but you give us permission to show, edit and use it to run and improve the App.

8. Data sources

Hockey statistics and schedules come from the NHL's public stats site. Injury statuses, starting goalies and news headlines come from DailyFaceoff; line combinations are worked out from the NHL's public shift data. This data is provided as is, and may be wrong, incomplete or late. Fantasy Apples is not affiliated with or endorsed by the NHL, the NHLPA, DailyFaceoff, Yahoo or any other fantasy platform. Team, league and platform names belong to their owners. Ratings and rankings in the App are our own calculations, not advice.

9. No warranty, limitation of liability and indemnity

No warranty. The App is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.
Limitation of liability. To the extent the law allows, we are not liable for indirect or consequential losses, or for lost data, wins or winnings. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or $50 if you paid nothing.
Indemnity. You agree to cover our reasonable costs from claims caused by your breach of these Terms or your posts.

Nothing in these Terms limits rights you have as a consumer that the law does not let us limit.

10. Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows when they last changed. For material changes we will also tell you in the App. If you keep using the App after a change, the new Terms apply.

11. Governing law

These Terms are governed by the laws of the State of Illinois, United States, without regard to its conflict-of-law rules, except where the law of your country of residence gives you consumer protections that cannot be waived.
